GREEK ELECTION: Athens Bar Association declares June 17th election null and void, suspects criminal activity

Very little surprises me about the eurozone any more, but this latest development out of Athens beats anything yet seen: the Athens Bar Association (DSA) has just released a memorandum declaring the recent Greek general election void because of an out-of-date census having been used…and hints darkly at the ulterior motives of Elstat, the national statistical organisation originally found to have been complicit in the plot to disguise Greece’s true fiscal position in its reports to the European Commission in 2008.

In a nutshell, the 2011 census was not used last week: the June 17th election seats-per-constituency allocation was based on the 2001 census…now over a decade out of date.

The DSA release follows:

IOANNIS ADAMOPOULOS, President of the Athens Bar Association (DSA).

EXTREMELY SERIOUS CONTITUTIONAL FAILURE

‘The number of parliament members for every constituency being defined by presidential decree based on the legal population of the constituency that results according to the latest census, the results of the latest census are considered published based on the data gathered by the relevant services, one year after the date the census actually took place”.

In this case, the last census was completed by the National Committee of Statistics (ELSTAT) on 24th May 2011 – a date which is official, and confirmed beyond any doubt by a press release from ELSTAT.

Therefore, as a year has already passed since the last day of the completion of the above mentioned census,  the number of parliamentary seats in every constituency should be defined based on the legal population of these constituencies, as derived, according to this census.’

In fact, the 2001 census data was used.

The release continues:

‘An extremely serious constitutional failure has occurred, as we estimate that substantial changes have occurred in the population distribution in every constituency in comparison with the previous census of 2001.

Not only the redistribution of the parliamentary seats in every constituency but also the redefinition of parliamentary representation of every party, is possibly at risk. In view of all the above, the DSA expresses its deep institutional concern regarding the risk of an acute constitutional crisis which is expected to cause damage to the function of the democratic institutions.’
But the real sting is in this final paragraph:
‘This is, of course, not the first time that actions or omissions by ELSTAT required further investigation and criminal evaluation. We remind readers that already, since 29th September 2011, DSA has filed a law suit with regard to very serious offences committed by ELSTAT concerning the illegal overstatement of the revised deficit of 2009 to 15.4%, as a result of which we now see the subjection of Greece to the current Memorandum and the subsequent imposition of austerity and other measures on the Greek People.’

  2. It’s pretty meaningless really. There won’t be a recalculation of the seats and there won’t be a new election. The Greek people do not have the stomach for any more politicing – they just want a government – any government, and the continuance of the bail-out funds.

    Explosive! If ELSTAT are involved in serial corruption, who’s pulling their strings? Greek powerful elites? a foreign government? Or are there people within ELSTAT with their own agendas? Time for another election methinks…they haven’t had one for at least 5 days!

      Who knows? Remember the martian landing failure years ago? The failure was blamed publicly on one major firm neglecting to change Imperial units to metric in the calculations. Now that story was VERY hard to believe, for me at least, although in my professional life I have seen colossal oversights by seemingly highly-trained people of great repute. Staggering, actually. 2011 switched to 2001? Maybe a local epidemic of dyslexia? And perhaps a fair proportion of bankers are cross-eyed twits? Who’d have thought it?

      I doubt John would take that too seriously in particular, but his theme seems to be “don’t let anything surprise you these days.”

      There is a general tendency afoot to look for conspiracy and crime everywhere while neglecting the more ubiquitous and urgent forces of entropy and incompetence.

        @Geo: I wasn’t looking for a conspiracy theory…if you read JW’s final paragraph, it points strongly to serial corruption, not serial incompetence.
        If there are any upstanding police over there, they need to investigate.

  7. It’s all noise now. Seems the big reset is now upon us. Its like quicksand: every move that they make only makes it worse and more inevitable. If there is a bright spot it’s that it’s always fun to watch these political and financial terrorists make every desperate move they can to attempt to survive. And then fail every time.

    I think we can all sense that it is here. Not soon, but now.

    Something better may be along afterwards.

    If the Greek Bar Association has the evidence it clearly claims, shall we expect people in ELSTAT to be arrested by the police and quickly charged with whatever crimes are appropraite? And a new election called or at least the results recalculated using the 2011 census data, if that’s possible?

        For legs to grow, there have to be official objections files by MPs – even by one MP. Nothing so far – the issue has been silenced by all parties. Nobody wants another election in a month, no party wants the results changed – all in all, nobody wants the hot potato!

      • @BT: having met a few of our MPs and party high ranks, i sensed that most of them do understand. There’s always some stupid and myopic guys in their ranks, but most of them are aware of the consequences. What i see in their eyes and their body language is that greed, ambition and selfishness prevails.

    Do they have such a thing as a supreme court? Maybe a constitutional court? You’d have thought they would ahve jumped on this by now or someone could cunningly work out how many seats the New Democracy would not have now……
    Ironic that a battle to hear the people is being fought in Egypt too. The cradle of democracy and the cradle of civilisation.

    JW – did I read that right?

    The lawyers are saying that ELSTAT OVER- , yes, OVERstated the 2009 deficit at 15.4% of GDP?. And there was I thinking that ELSTAT had UNDERstated the gap between incomings and outgoings.

    Is this like Healey being misled by his own Treasury about the likely 1976 PSBR? Are the Greek lawyers really saying the deficit was SMALLER than ultimately portrayed?

        In all fairness – if a no fly zone was required in Syria. It would not be done using F4′s ! You can be absolutely certain that Cruise would be taking out the defence infrastructure and F22′s would be having a good look in as a preliminary to set up any such zone. Drones are politically expedient also as they do not have an actual (home) body count to concern western conciences. Once the Tomcats get airborn (still pretty much invincible) there is no way a country like Syria is going to put its airforce (or more correctly – its pilots) in the sky (for long).

        War is a new game – where political fallout is only going to be really likely ‘if you lose’. Now it will be down to the ability to take out a carrier or two. Should a country like Syria achieve this – the ‘Hand of God’ would put them back in the pre-stone age ! I cannot see either Russia or China becoming THAT involved in support of Assad.

        It would take quite a bit to convince me (now) that the real issues behind ‘Gulf War 1, 2 & Afghanistan’ were more about a desire (or need) to test out new weapons, techniquesand tactics. To hone them against serious but not major threats. (Hence the suggestion over Kuwait invasion – that it was suggested by Saddam that he believed that he had US unofficial sanction to go ahead.) Conspiracy ? Maybe ! But through hindsight and analysis……..things appear to make a bit of a story. I am not saying everything is a ‘CIA plot’ or anything, just that the chances were taken as they presented themselves…………GW 1 ‘could’ have been finished off 1st time around…..and AQ were not even a twinkle back then !
